1. INTRODUCTION

StreamlineCE ("StreamlineCE," "we," "our," or "us") is committed to respecting your privacy. This Privacy Policy (the "Privacy Policy") applies solely to all individual users who visit or otherwise interact with our Platform (as defined below), including, but not limited to, freelance developers, creators, presenters, and viewers of continuing education content (each, a "Contributor," or "you" or "your").
This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit our Collaboration Platform (available at http://streamlinece.com) and interact with or otherwise use any of the content, features, or services offered or otherwise made available through it (collectively, the "Platform"), and our practices for collecting, using, disclosing, retaining, protecting, and otherwise processing that information.
This Privacy Policy applies to information we collect:
  • through your use of our Platform;
  • in email, text, and other electronic communications between you and us, such as when you contact us or otherwise submit information to us, whether by telephone or through other means; and
  • from third parties.
This Privacy Policy does not apply to information collected by:
  • us offline or through any other means, including on any other website or Platform operated by StreamlineCE or any third-party;
  • us or any of our affiliates or subsidiaries related to your or any other individual's employment or potential employment with us; or
  • any third party, including through any application or content (including advertising) that may link to the Platform.
Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, please do not visit, access, interact with, or otherwise use our Platform. By accessing or using our Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Platform after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

2. INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

Throughout this Privacy Policy, the term "Personal Data" means any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. However, Personal Data does not include any deidentified, anonymized, or aggregated information.
Generally
We collect Personal Data about you from various sources, including:
  • directly from you when you provide it to us, such as when you communicate with us or otherwise access or use the Platform (e.g., registering for an account or creating an account profile on the Platform; participating in an activity that is coordinated by a Provider (as defined below) (each, an "Activity"), applying for speaking, writing, and other opportunities related to the development of an Activity ("Contributor Roles") via a listing of open Contributor Roles posted by Providers on the Platform (the "Opportunity Board"), and sharing data with non-subscribing Providers, etc.);
  • automatically as you navigate through or otherwise use the Platform;
  • from third parties, for example, providers of continuing education who subscribe to StreamlineCE ("Providers"). Providers are the subscribers who manage Activities within the Platform and create Contributor Roles that are added to the Opportunity Board, among other things; and
  • information that we create about you as you use the Platform.
Information You Provide to Us
We collect the following types of Personal Data directly from you when you provide it to us or otherwise access or use our Platform (including any services, features, or content through which they are offered): first and last name, date of birth, mailing address, telephone number(s), email address, password (for logging in to your account), and security question and answer (for identity verification purposes). 
We also collect information about your opportunity preferences (e.g., the types of Activities you would like to participate in, your willingness to travel for Activities), your expected baseline honorarium, preferred pronouns, and the most commonly required information Providers must collect for accredited continuing education activities including, but not limited to, the most recent copy of your Curriculum Vitae (CV), a short biography about yourself, a headshot of you, as well as your conflict of interest details, and professional-related information (e.g., profession, specialty area(s), and area(s) of practice; your employer/affiliation; number of years you have been in practice; other Activities you have participated in through the Platform; writing samples; and links to any public profiles, such as a LinkedIn profile).
In addition, if you:
  • contact us or customer support, we may collect records and copies of your correspondence (including emails);
  • arrive at StreamlineCE from an external source (such as a link on another website or in an email) or have been invited to join the website with a referral code, we may also collect information about the source that referred you to us; and/or
  • participate in an Activity as a Contributor, we collect data related to your participation in such Activity, including: (i) Activity information and tags (e.g., names of the program/Activity and participants involved); (ii) invitations and communications sent to Contributors already on the platform, those invited externally through the platform, and application data for Contributor Roles within an Activity; (iii) changes and other events within each Activity including, but not limited to, file uploads, communications, schedules and timelines, and contracts; and (iv) feedback about an Activity that you share as a Contributor.
You also may post information, including Personal Data, within an Activity via the Platform and, in such a case, that information will be shared with any other Contributors or Providers involved in that Activity. Please note that you must use a secure encrypted connection or other appropriate measures when transmitting Personal Data to our Platform.
Information We Collect Through Automatic Data Collection Technologies
We may also use automatic data collection technologies to collect certain Personal Data about your interaction with our Platform. This can include information about your equipment, browsing actions, and patterns, such as:
  • details of your use of the Platform, including browsing history, search history, traffic data, location data (which may be used to locate the city and state that you are in but cannot be used to precisely locate you), log file information, referring/exit pages, date and time of your visit, error information, links clicked, read receipts for any messages or invitations sent by Providers that you open, and other communication data and the resources that you access, use, or otherwise interact with when using our Platform (e.g., when you initiate an application for a Contributor Role on the Platform, we may collect certain information, such as about job listings you viewed and job applications you started and completed); and
  • information about your computer, mobile device (and related network information), and Internet connection, such as your IP address, operating system, browser type, device ID, and MAC address.
Other information we collect automatically includes Personal Data, or we may maintain it or associate it with Personal Data we collect in other ways. It helps us to improve our Service and to deliver a better and more personalized service by enabling us to: (i) estimate our audience size and usage patterns; (ii) store information about your preferences, allowing us to customize how our Platform appears to you according to your individual interests; (iii) speed up your searches; (iv) identify areas for improvement and further engagement; and (v) recognize you when you return to use our Platform.
The technologies we use for this automatic data collection may include:
  • Cookies (or browser cookies). Cookies are small data files placed on your computer or mobile device that allow us to collect certain information whenever you interact with and use our Platform. These cookies are managed by us (first-party cookies) and are otherwise referred to as session cookies (which expire once you close your browser). Each time you access the Platform, a session cookie containing an encrypted, unique identifier is placed on your device. These session cookies allow us to uniquely identify you when you use the Platform and allow us to maintain your login session. Session cookies are required to use the Platform and are removed when you logout or close your browser window to the Platform.
  • Web Beacons. Pages of our Platform and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related Platform statistics (e.g., recording the popularity of certain website content and verifying system and server integrity).
Information We Collect from Third Parties
We may collect Personal Data from third-party sources, such as LinkedIn, Provider databases, and other websites and data brokers. When we associate this information with other Personal Data about you, we consider this information to be Personal Data. This information may include, but is not necessarily limited to, your first and last name, email professional-related information, other Activities you have participated in. In addition, we may also collect limited Personal Data from Providers (such as names and email addresses) who include this information within their Private Contributor Library on the Platform, as further described in Section 4 of this Privacy Policy.
Information We Create About You
We may combine information about Contributors from the third-party sources noted above with information we hold about you to create and/or update your user profile. When we associate this information with other Personal Data about you, we consider this information to be Personal Data.

3. HOW WE USE THE INFORMATION WE COLLECT

We use information that we collect about you, including any Personal Data, as described above, to:
  • provide our Platform and its content to you;
  • enable you to participate in the interactive features of our Platform;
  • support, develop, troubleshoot, debug, and improve our Platform;
  • create and maintain your account and related profile on our Platform;
  • provide you with notices about your account and/or profile;
  • respond to your questions, comments, and requests, and to provide customer support;
  • connect you with and supply necessary information to Providers for Activities for which you are applying or on which you are collaborating;
  • incorporate your profile in a network of Contributors that can be accessed by Providers who subscribe to a plan that includes this feature (the "Universal Contributor Library");
  • complete other transactions you have requested using the Platform, and provide you with products and services you request;
  • maintain a record of your activity when using the Platform;
  • communicate with you about our products, services, offers, and promotions;
  • operate, evaluate, and improve our business and the products and services we offer;
  • analyze and enhance our marketing communications and strategies;
  • analyze trends and statistics regarding use of the Platform;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity;
  • carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including our Terms of Service;
  • notify you about changes to our Platform or any products or services we offer or provide though it;
  • evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about the users of our Platform is among the assets transferred;
  • comply with our legal, regulatory, and contractual obligations, plus applicable industry standards;
  • fulfill any other purpose for which you provide it, or in any other way we may describe when you provide the information; and
  • use it for any other purpose with your consent or as otherwise permitted or required by law.
In addition, we may combine the information we collect with publicly available information and information we receive from the third-party sources described above for the purposes identified in this section.

4. DISCLOSURE OF YOUR INFORMATION

We do not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this Privacy Policy. We may disclose aggregated or anonymized information about our users, and information that does not otherwise identify any individual user (i.e., non-Personal Data), without restriction. We may disclose Personal Data that we collect from or about you as described in this Privacy Policy to:
  • Providers for accreditation purposes. In addition, we may disclose read receipts for any messages or invitations sent by Providers that are opened by a Contributor. We may also disclose the names and email addresses of Contributors within a Provider's Private Contributor Library, upon request by the Provider, for the purpose of the Provider to contact you in the future outside of the Platform (subject to your exercise of opting-out of having your information shared with the provider within seven (7) days of receiving the notice from us. You acknowledge and understand that StreamlineCE has no control over how Providers use this data following disclosure;
  • contractors, service providers, and other third parties we use to support our business; and
  • a potential or actual buyer or other successor in the event of a planned or actual merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of StreamlineCE's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by StreamlineCE about our Platform's users is among the assets transferred.
We may also disclose your Personal Data:
  • to comply with: (i) federal, state, or local laws, or to comply with a court order or subpoena to provide information; (ii) civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; and/or (iii) certain government agency requests for emergency access to your Personal Data if you are at risk or danger of death or serious physical injury;
  • to cooperate with law enforcement agencies concerning conduct or activities that we (or one of our service providers') believe may violate federal, state, or local law;
  • to exercise or defend legal claims, and to enforce our Terms of Service and other agreements, including investigating potential violations;
  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of StreamlineCE, our users, or others;
  • to fulfill the purpose for which you provide it;
  • for any other purpose disclosed by us when you provide the information; and/or
  • with your consent or as otherwise permitted by applicable law.
Please note that information you share within an Activity is shared with any current and future collaborator within that Activity. In addition, any information you share in a direct message thread on the Platform (which includes the chat history relevant to that thread) may be shared with any other Contributors or representatives from the Provider's team that are subsequently added to the chat by one of the parties in the thread (similar to the forwarding of an email). This information is considered public and is not confidential.

5. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

  • Cookies. You can adjust the settings in your browser's settings to refuse all or some cookies. If you disable or refuse cookies, please note that certain parts of our Mobile App and/or Website may be inaccessible or not function properly. You can find more information about cookies at http://www.allaboutcookies.org.
  • Web Beacons. Web beacons can be refused when delivered via email by disabling HTML images or refusing HTML (select "Text Only") emails via your email software. In many instances, web beacons are reliant on cookies to function properly, and so declining cookies will impair their functionality.
  • Marketing Communications from StreamlineCE (Email). If you do not wish to have your email address used by StreamlineCE to advertise and/or promote our own products or services or open Contributor Roles posted by Providers on the Platform (also known as "Opportunities") that we recommend to you, you can opt-out of those communications at any time by clicking the unsubscribe link at the bottom of any email or other marketing communications you receive from us. In addition, you can opt out of receiving emails relating to Opportunities we have recommended to you at any time by adjusting your communication preferences in your profile on the Platform. Opting-out of these communications does not apply to information provided to StreamlineCE as a result of a Platform experience, account, or related service.

6. YOUR OTHER RIGHTS

In addition to the choices made available to you with regard to the Personal Data that you provide to us, you can review and change the Personal Data associated with your account by logging into your account and visiting your account profile page.
You may also send us an email at admin@streamlinece.com to request access to, correct, or delete any Personal Data that we have collected about you. We cannot delete your Personal Data except by also deleting your user account. We may not accommodate a request to change or delete your Personal Data if we believe the change or deletion would violate any law or legal requirement, cause the information to be incorrect, or otherwise interfere with the needs of Providers who have a legitimate need to maintain such information.
If you delete your User Contributions from the Platform, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Platform users.

7. DATA SECURITY

We have implemented reasonable measures designed to help secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. However, we do not guarantee that your Personal Data will be free from loss or unauthorized access, use, alteration, or disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to our Platform, you are responsible for keeping this password confidential. You are not permitted to your password with anyone. You are also responsible for limiting access to your user account, computers, and devices that you use in connection with your access to and use of the Platform.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our Platform. Any transmission of Personal Data through or outside of our Platform is at your own risk. You must use a secure encrypted connection or other appropriate measures when transmitting Personal Data to our Platform. We are not responsible for circumvention of any privacy settings or security measures deployed on our Platform, nor are we responsible for any information you disclose outside of our Platform via email or through any other means.

8. DO NOT TRACK

Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they "do not track" your online activities. However, there is no accepted standard for how a website or online service should respond to this signal and, at this time, we do not honor such a signal or modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.

9. DATA RETENTION

We retain the Personal Data we collect for as long as needed to carry out the purposes as described in this Privacy Policy or as otherwise required by applicable law, taking into consideration any statutorily required minimum periods of time in applicable jurisdictions. However, we may also retain your Personal Data for longer periods of time when your information is subject to one of the following exceptions:
  • When stored in our backup and disaster recovery systems. Your Personal Data will be deleted when the backup media your Personal Data is stored on expires or when our disaster recovery systems are updated.
  • When necessary for us to exercise or defend legal claims.
  • When necessary to comply with a legal obligation.
  • When necessary to help ensure the security and integrity of our Service and IT systems.
In addition, Personal Data will be stored within any Activity in which a Contributor participates. At the time of the Activity, a snapshot of relevant Personal Data from the Contributor's profile will be copied and stored within the Activity until such Activity is no longer offered through the Platform – and this will occur as soon as the Provider of that Activity is no longer a subscriber to our Platform. Your Personal Data will be deleted when we no longer require your Personal Data for any of the above purposes.

10. THIRD-PARTY SITES, APPLICATIONS, & PLATFORMS

Our Platform may contain links to third-party websites, services, applications, or platforms that are not owned or controlled by us. For example, a Provider may use a third-party site to organize a conference where each speaker (e.g., Contributors) uploads their materials, which are automatically added to a mobile application that the conference attendees can use to access the presentation slides. In another realistic scenario, a Provider may require a Contributor to use third-party video conferencing software (e.g., Zoom, Skype, Microsoft Teams, etc.) for their webinar presentation. In both of these examples, the privacy practices of the Provider and/or third-party provider control, as we are not responsible for the privacy practices of any third-party websites, services, applications, or other platforms. The privacy practices of these third parties, including details on the information they may collect about you and how they use it, are subject to the privacy statements of those parties, which we suggest you review.

We use Google reCAPTCHA v2 to protect our platform from spam, abuse, and automated activity. reCAPTCHA analyzes information such as your IP address, browser details, device settings, and user interaction patterns on the site to determine whether activity is legitimate. The collection and use of this information by reCAPTCHA is subject to Google’s Privacy Policy and Terms of Service, which you can review at: https://policies.google.com/privacy and https://policies.google.com/terms

11. CHILDREN UNDER THE AGE OF 18

Our Platform is not intended for children under 18 years of age, and we do not knowingly collect Personal Data from children under 18. Parents and guardians should at all times supervise their children's activities.
If you are under 18, please do not use or provide any information on our Platform, register on or through the Platform, use any of the features or services of our Platform, or provide any information about yourself to us, including, but not limited to, your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information directly from a child under 18, please contact us at admin@streamlinece.com.

12. CONSENT TO PROCESSING OF PERSONAL DATA IN THE UNITED STATES

In order to provide our Platform to you, we may store and process your Personal Data outside of the country where you reside or are located, including to countries that may not or do not provide an equivalent level of protection for your Personal Data.By using our Platform, you represent that you have read and understood the above and hereby consent to the storage and processing of Personal Data outside the country where you reside or are located, including in the United States.

13. CHANGES TO OUR PRIVACY POLICY

We reserve the right to update or change this Privacy Policy at any time. It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users' Personal Data, we will notify you by email to the email address we have on file for you, through a notice on the home page of our Platform, or by using a similar method. The date this Privacy Policy was last updated is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Platform, and this Privacy Policy to check for any changes.
